| J&D's Contract PUPPY/DOG SALES CONTRACT This contract made this_________day of _____________,________ and between J&D’s Pups and__________________________ is in regard to the sale of the following dog or puppy. Name:_______________________________ Sex:__________ Age:_______________ Color/Markings:_______________________ The above named dog is being sold as a Pet/Companion Animal for the sum of $__________________. A deposit must be paid to hold the above puppy and is NON REFUNDABLE. Purchase price is also NON REFUNDABLE. See below for further details to this sale. BREEDER AGREES: * Above dog/puppy has been vet examined and is found to be in good health and vet checked certificate supplied when shipped. * Above dog/puppy is up to date on its immunizations and de-worming. Health record will be supplied. * To supply buyer with shot record, NO registration information or AKC papers, (If received on time) or receipt, and any other necessary paperwork at time of purchase. At the time of sale, this dog/puppy is considered and being sold as pet quality. Debbie Paulina, breeder, offers no guarantee that disqualifying faults will not arise at a later date which would make this puppy unsuitable for the show ring. 48 Hour Health Guarantee: This dog/puppy is guaranteed to be in good health at the time of delivery a document the dog/puppy is in good health is attached. For the protection of the purchaser and seller, the dog/puppy should be examined by a licensed veterinarian. If the dog/puppy is declared unacceptable health by a licensed veterinarian within 48 hours of the purchase/shipment date, he/she should issue a written statement of diagnosis, including detailed description of all symptoms supporting that diagnosis, reason any tests were performed, and the reason why he/she feels that the dog/puppy is poor health risk, must be presented at the time the dog/puppy is returned. The dog/puppy must be returned to us within 48 hours of purchasing date. If the Buyer does not take the dog/puppy to a veterinarian within 48 hours from the date of purchase, this warranty becomes null and void. As of the date of delivery, the dog/puppy has received proper vaccinations and de-worming. The buyer has been informed of these and of future vaccinations and de-worming due. * Dog/Puppy must be paid in full before being shipped or at the time of pick up. All deposits are NON-REFUNDABLE. We DO NOT refund money, we will replace the dog/puppy with one of equal value from the same litter if available of another litter, only if our veterinarian is in agreement with the diagnosis of your veterinarian. Shipping cost is non-refundable. If the dog/puppy is not examined by a licensed veterinarian, no guarantee is given. BUYER AGREES: * To have above dog/puppy vet checked within 48 hours of possession. That all vet bills are the responsibility of the buyer. * To keep the above dog/puppy up to date on all immunizations and health care. * To notify the breeder if they can no longer care for the dog/puppy, that the buyer will give the breeder first chance to buy back the dog/puppy at the price no higher that the sale price. * Provide dog/puppy with routine preventive care. Annual physical examinations by a licensed veterinarian. Give all immunizations. Administer heart worm preventative monthly. Breeder is not responsible for any veterinary costs incurred by the dog. Breeder is not responsible for any transportation costs incurred in returning or replacing the dog/puppy. This contract applies to the original buyer only and is non-transferable to a second party. This contract is null and void if any of the terms and conditions are not fulfilled. It is also recommended that a better pet is made by having your new pet spayed or neutered at or approximately six months of age. TERMS OF REPLACEMENT: If the above dog should develop a severe genetic disease and can no longer function as a Pet/Companion Animal the breeder will replace at no charge with a comparable value (ie. Animal or Pet/Co). The dog will be replaced either from the same litter of from a future within a year of the dog being returned to the breeder. A proper letter from the vet stating the problem found and the vet's opinion on the viability of the animal must accompany the returned dog/puppy. All the vet bills and returned shipping fees are the responsibility of the buyer and will not be accepted by the breeder. No refund, in part or in full will be given for the for the following: There are certain disorders that may be caused by environmental factors, for example: Coccidia, Kennel cough, Cancer, Demodectic Mange, Scabies, growths, (molera in Chihuahua‘s or Griffy's), testicles, petitals, hernias, Calcium drops, hypoglycemia (low blood sugar), allergies and other autoimmune system disorders that are not covered in this guarantee. Coccidia and Kennel Cough are common in puppies that are stressed by new ownership or shipped. This guarantee does not include uneven bites, size or color or umbilical hernia, and parvo virus. This contract applies to the original buyer only and is non-transferable to a second party. This contract is null and void if any of the terms and conditions are not fulfilled. All items covered under this guarantee are replacement only. We do not give refunds. Unless otherwise specified, all vet bills for corrective surgery, cosmetic surgery, shots and normal health care, euthanasia, spay/neuter and also shipping are the responsibility of the buyer. I have read the above contract thoroughly and understand and agree with the terms set forth in this document. I also understand that this is a binding agreement and will abide by the terms we have agreed above. I acknowledge my acceptance of this contract with my signature below. All Sales are Final !
